Online Bill Pay Agreement

Sarah Bush Lincoln Health System ("SBLHS") offers on-line billing statements and payment services ("Bill Pay Services") for the convenience of electronic account payments. Please note by visiting the SBLHS website and using Bill Pay Services, you agree to accept the terms of this Agreement. SBLHS may modify this Agreement from time to time. The modified Agreement shall be effective immediately upon posting to the SBLHS website and by continuing to use our Bill Pay Services after the modified Agreement has posted, you agree to accept the modified terms.

  1. Authorization for Payments: You authorize the payment of bills owed to SBLHS by designating a bank or financial institution account ("Account") and by authorizing SBLHS to execute your on-line payment authorizations on the Account. It is your responsibility to establish, maintain, fund and pay all fees associated with the Account designed for Bill Pay Services. SBLHS does not charge a fee for electronic payments.

  2. Electronic Payments: Upon receipt of your payment authorization, SBLHS will charge the Account to recover an electronic payment in the amount authorized. Please note electronic payments may require at least five business days after you authorize payment to process and post payment to SBLHS. We will use our best efforts to promptly process payment authorizations SBLHS receives. SBLHS has no obligation to notify you when a payment cannot be processed and in no event will SBLHS be responsible for any failure to process a payment authorization caused by one of the following circumstances:

    • a. Inaccurate or incomplete payment authorizations including incorrect account names or account information, errors in using Bill Pay Services, and equipment failure;

    • b. Events outside of human control (such as, but not limited to, fire, flood and Internet outage) despite SBLHS taking reasonable precautions to avoid such events;

    • c. The Account has insufficient funds to complete the transaction; and

    • d. The bank or financial institution maintaining the Account refuses or is otherwise unable to honor your authorized payment.
  3. Disclaimer of Warranties: Bill Pay Services, the SBLHS website and any services obtained through the website are provided "as is" and without warranties of any kind. To the fullest extent permissible pursuant to applicable law, SBLHS and its affiliates, licensors, suppliers, vendors, advertisers, sponsors and agents disclaim all warranties, express or implied, including, without limitation, warranties of title or non-infringement, or the implied warranties of merchantability and fitness for a particular purpose, and any warranties that may arise from course of dealing, course of performance or usage of trade.

    SBLHS and its affiliates, licensors, suppliers, vendors, advertisers, sponsors and agents do not warrant that your use of the website or the service will be uninterrupted, error-free or secure, that defects will be corrected, or that the website or the server(s) on which the website is hosted are free of viruses or other harmful components. SBLHS also does not guaranty the absolute security, integrity, or confidentiality of any information transmitted to or from the website or stored within the website because no website or electronic transmission can be absolutely protected against intentional or malicious hacking attempts and SBLHS has no control over the way in which you may access the Internet or choose to submit information.

    You are responsible for obtaining and maintaining all telephone, Internet, computer hardware and other equipment needed to access and use the website, and all charges related thereto. You assume all responsibility and risk for your use of the website and the Bill Pay Services and your reliance thereon. Your use of the website and any service rendered through the website are entirely at your own risk.

    Although we attempt to ensure the integrity of the website, we make no guarantees as to the website's completeness or accuracy. In the event you question the website's completeness or accuracy, please contact us with, if possible, a description of the material to be checked and the location (URL) where such material can be found on the website, as well as information sufficient to enable us to contact you. We will try to address your concerns as soon as reasonably practicable.

  4. Limitation on Liability: Your use of Bill Pay Services is entirely at your own risk. SBLHS, its affiliates, licensors, suppliers, vendors, advertisers and sponsors shall in no event be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or any other monetary or other damages, costs including attorneys' fees, fines or penalties arising out of or relating to your use of Bill Pay Services. Your exclusive remedy for dissatisfaction with Bill Pay Services is to stop using Bill Pay Services.

  5. Miscellaneous Terms: This Agreement is governed and shall be construed according to the laws of the state of Illinois, without regard to conflicts of law principles. This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements, oral or written, regarding Bill Pay Services.
